The word “probate” often inspires fear.  In Utah that is unnecessary.  The probate process in Utah is far less costly and time-consuming than in almost any other State.  In California the obsession with avoiding probate is real; in Utah that obsession is highly exaggerated.

Since the 1970s Utah has operated under the Uniform Probate Code, which generally provides for prompt and cost-efficient probate of a Utah estate.  In short, probate in Utah should not be feared. 

Notwithstanding Utah’s improved probate procedure, probate may still pose significant costs and delays if there is substantial conflict among the heirs and beneficiaries.  If that is the case, our experienced attorneys are prepared to use all available tools in the probate toolchest to resolve such conflicts.
